This Privacy Notice applies to all information received by the Foundation, both online and offline, to the extent applicable under relevant law. This includes, but is not limited to, information gathered through online and in-person events, virtual workshops, online courses, podcasts, social media interactions, website content, e-books, e-newsletters, and any other electronic, written, or oral communications you have with us. It also covers information you provide to third-party vendors acting on the Foundationโ€™s behalf when you interact with us as a website visitor, donor, fundraiser, or support staff (collectively, the โ€œServicesโ€). 

We periodically review and update this Privacy Policy to reflect changes in our practices, legal requirements, and regulatory guidance.

The Personal Information That We Collect or Process 

“Personal Information” is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home address, payment information, commercial information, internet activity, geolocation, professional information, and inferences drawn from other data, as defined under applicable privacy laws (for example, account information such as name, postal address, and email address, any other identifier we may use to contact you online or offline).  

The specific information we collect depends on how you interact with the Foundation. The types and categories of personal information we collect, or process include:

  1. When You Visit Our Website
    • Payment information, including credit card or debit card information and information about the payment methods and services (such as PayPal) you make a donation to the Foundation.ย 
    • Donation history, including information about your past donations.
    • Location information, including general geographic location such as country, state or province, or city.ย 
    • Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
    • Content and information you elect to provide in communications sent to us.ย 
    • Images, voice recordings, and videos collected or stored in connection with the Services, if you have consented to such information collection in written release.
    • Our website may include social media widgets or other third-party tools, data collected by these widgets and tools is subject to their own privacy policies.ย 
  2. When You Register for our Events or Webinars or Complete a Form
    • We may collect your name, email address, physical address, and any information you choose to share, including your attendance type (patient, caregiver, table representative).
  3. When You Make a Donation
    • Contact information, including name, address (such as home address, work address, or other address), email address, phone number, and other contact information you provide us.
    • We may collect your name, contact information, payment details, and donation history to process your contribution, issue receipts, and maintain accurate records and acknowledge receipt of your donation for tax purposes.
    • When you send a donation in honor or in memory of someone and request that an acknowledgement be sent to another individual, we will use the name and address of that individual for acknowledgement purposes only.
  4. When You Contact Us
    • Your name, email address, phone number, and information you choose to provide us as part of your communication to us, including when you fill out our subscription form for our e-mails.

We also collect:

  • Statistics or aggregated information.ย Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal information. For example, we may aggregate personal information to calculate the percentage of users accessing specific website features.
  • Technical information.ย Technical information includes information about your internet connection and usage details about your interactions with the website, such as clickstream information to, through, and from our website (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with personal information so that it directly or indirectly identifies an individual, we will treat the combined information as personal information.

We may share your information with Google Analytics to track and analyze the use of the Services. The Google Analytics Advertising Features that we may use include: Google Analytics Demographics and Interests Reporting, Google Display Network Impressions Reporting and Remarketing with Google Analytics. You Provide Information to Us

We collect information about you when you interact with our Services, participate in surveys, fundraisers, contests, or promotions.

Automatically Through Our Services

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal information. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, and other communication data, and which resources and Services features that you access and use. 

Using automatic collection technologies helps us to improve our Services and to deliver a better and more personalized experience.

From Business Partners and Service Providers

Our analysis may include the use of technology like third-party machine learning and large language models, which may include training these models or sharing with third parties for model training. ย We do not sell or share your personal information to train any models without your consent. ย 
  • Promote our mission by placing ads on third parties’ services.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We may also disclose your personal information:

  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our donors, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

If we transfer your personal information outside your country of residence, we will ensure that appropriate safeguards are in place to protect your information in accordance with applicable data protection laws.  These safeguards may include entering into Standard Contractual Clauses approved by the European Commission or other relevant authorities, implementing binding corporate rules, or relying on other lawful transfer mechanisms recognized under applicable law.  Where required, we will also take additional measures to ensure that your personal information receives a level of protection essentially equivalent to that provided in your home jurisdiction.

Your Rights and Choices About Your Information

This section describes mechanisms you can use to control certain uses and disclosures of your information and rights you may have under state law, depending on where you live.

  • Cookies and Other Tracking Technologies.ย You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Services to collect information through other tracking technologies by opting out via cookie banner. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly. Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals.   • Disclosure of Your Information for Third-Party Advertising.ย If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by sending us an email stating your request to [email protected]. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

How We Retain Your Personal Information

We keep the categories of personal information described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal information. At the end of the retention period, personal information will be deleted, destroyed, or deidentified.  We will also deidentify or anonymize data where possible.

How We Protect Your Personal Information

We use reasonable administrative, physical, and technical measures designed to protect your personal information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal information transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal information is at your own risk. 

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal information against unauthorized use, disclosure, and access.

Your Rights

You may have rights under certain United States state or international data protection laws. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.  Depending upon where you are located, you may have some or all of the following rights in relation to your personal information:

  • ask for access to your personal information via a ‘subject access request’;
  • ask for personal information we hold about you to be corrected;
  • ask for your personal information to be deleted. This enables you to ask us to delete or remove your personal information where there is no good reason for us continuing to process it;
  • object to the processing of your personal information where we are relying on a legitimate interest, and there is something about your particular situation which makes you want to object to processing it;
  • ask for the processing of your personal information to be restricted. This enables you to ask us to suspend the processing of personal information about you; and
  • ask for your personal information to be transferred to another company.

To protect your privacy and security and the identity of the Foundationโ€™s donors and community members, we will take certain steps to verify your identity before granting access to your information or complying with other requests. We may ask to see a copy of your ID or ask you specific security questions to confirm your identity.

We endeavor to respond to a rights request within the required timeframes under applicable laws (which will vary depending on your location). If we need more time, we will inform you of the reason and extension period in writing.

Where we rely on consent to process your personal information, you have a right to withdraw your consent at any time. To withdraw your consent to receive marketing emails from us, you can contact us using the information above or visit “Update Your Preferences” or โ€œUnsubscribeโ€ link at the bottom of all Foundation emails.

Childrenโ€™s and Minorsโ€™ Information

Our Services are not directed to children under 13 years of age in the United States, and we do not knowingly collect personal information from children under 13 without verifiable parental consent, in compliance with the Childrenโ€™s Online Privacy Protection Act.

For individuals located in the European Union or the United Kingdom, we do not knowingly collect personal information from children under 16, consistent with the General Data Protection Regulation.

If we become aware that we have collected personal information from a child without the appropriate consent or authorization required by law, we will delete it promptly.

For minors between the ages of 13 and 17 in the United States, we only process personal information with appropriate consent where required by applicable law.
